These Terms of Service ("Terms") govern your use of the MyRxProvider website and telehealth platform (the "Platform"). By creating an account or submitting an intake, you agree to these Terms. If you do not agree, do not use the Platform.
MyRxProvider provides a technology platform and administrative services. Medical care is provided by independent, licensed healthcare providers who exercise their own professional judgment. MyRxProvider does not practice medicine, does not interfere with clinical decision-making, and does not guarantee that any medication will be prescribed.
The Platform is not designed for medical emergencies. If you think you have an emergency, call 911.
Program fees are set out at enrollment. Access is arranged through participating employers; program fees are paid by you and billed to your selected payment method on a recurring basis until cancelled. You may cancel at any time; cancellation stops future billing and future shipments but does not entitle you to refunds of amounts already billed except where required by law.
Prescriptions, where issued, are dispensed by licensed U.S. pharmacies. You may elect to fill a prescription at any pharmacy of your choice. Medications must be used only by the person to whom they were prescribed. Do not resell or share medication.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
You agree not to misuse the Platform, including by attempting to obtain medication through false statements, using another person's identity, scraping or reverse-engineering the service, or interfering with its operation.
The Platform and its content are owned by MyRxProvider or its licensors. You receive a limited, revocable, non-transferable license to use the Platform for personal, non-commercial purposes.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYRXPROVIDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. NOTHING IN THIS SECTION LIMITS A PROVIDER'S PROFESSIONAL OBLIGATIONS TO YOU OR ANY LIABILITY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.
To the maximum extent permitted by law, MyRxProvider's aggregate liability arising out of or relating to the Platform shall not exceed the amounts paid by you (or on your behalf) for the service in the twelve months preceding the claim. This limitation does not apply to claims of medical malpractice against treating providers, gross negligence, or willful misconduct.
Any dispute arising under these Terms will first be addressed through good-faith negotiation. Disputes that cannot be resolved informally shall be resolved in the state or federal courts of competent jurisdiction, unless you and MyRxProvider agree in writing to arbitration.
We may update these Terms from time to time. Material changes will be communicated by email or in-Platform notice, and continued use after the effective date constitutes acceptance.
